1. Definitions
  • Electronic Gift Card (Ph.Doctor Voucher) - an electronic goods voucher issued to the bearer, constituting a legitimacy sign within the meaning of applicable legal provisions, authorizing the purchase of Goods in the Ph.Doctor online store phdoctorlab.pl within the established amount limit.
  • Publisher - PH DOCTOR N&D WIŚNIEWSCY SKA with its registered office in Wyszków (address: ul. Fryderyka Chopina 13/U2, 07-200 Wyszków), entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000951237, NIP: 7622012301, REGON: 388686123.
  • Purchaser – the person purchasing the Electronic Gift Card (Ph.Doctor Voucher).
  • User – each holder and bearer of the Electronic Gift Card (Ph.Doctor Voucher).
  • Ph.Doctor online store - the Publisher's online store available at www.phdoctorlab.pl.
  • Product – a product offered for sale in the Ph.Doctor Online Store.
  • Electronic Card Code – a string of characters assigned to the Electronic Gift Card, enabling the execution of a Transaction.
  • Transaction - an operation made using a Gift Card, consisting in the exchange of all or part of the amount available on the Gift Card for Products offered by the Issuer, as a result of which the amount available on the Gift Card is reduced by an amount corresponding to the value of the Products purchased by the User.

  1. Purchase and issue of an Electronic Gift Card
  • The Electronic Gift Card can be purchased at the Ph.Doctor Online Store.
  • The buyer has the option to purchase an Electronic Gift Card for a selected amount of PLN 100, 200, 300, 400, 500 gross.
  • The Electronic Gift Card is sent in the form of an e-mail. The content of the e-mail contains information about the Electronic Card Code number. The e-mail is sent to the e-mail address of the Purchaser or a third party provided by the Purchaser. The Purchaser cannot request an increase in the value of the Electronic Gift Card, which has already been paid for and sent to the provided e-mail address.
  • Payment for the Electronic Gift Card is possible using the payment methods provided by the Issuer in the Ph.Doctor Online Store.
  • No discounts are included when purchasing an Electronic Gift Card.
  • The Electronic Gift Card is not an electronic payment instrument, nor is it an electronic payment card.
  • The Electronic Gift Card cannot be exchanged for money (cash) in whole or in part, and the paid value of the Electronic Gift Card is not subject to interest.
  • The Buyer of the Gift Card purchased in the Ph.Doctor Online Store who is a consumer has the right to withdraw from the contract of sale of the Electronic Gift Card without giving any reason within 100 days from the date of conclusion of the contract, if they have not started using the Gift Card. Withdrawal from the contract for the Gift Card concluded via the Ph.Doctor Online Store and its return are subject to the principles of withdrawal and return resulting from the applicable provisions of law, in particular the Act of 30 April 2014 on consumer rights and the regulations of the Ph.Doctor Online Store.

 

  1. Using the Electronic Gift Card
  • The Electronic Gift Card (Ph.Doctor Voucher) enables multiple purchases of Goods in the Ph.Doctor Online Store. The User may use the Electronic Gift Card from the moment it is received in the form of an e-mail, the content of which contains the Electronic Card Code.
  • The Electronic Gift Card is valid for 12 months from the date of receipt via email.
  • The Electronic Gift Card is redeemed by entering the Electronic Card Code in the "Discount code or gift card" field and clicking the "Apply" field.
  • When redeeming an Electronic Gift Card, the User is not entitled to receive change in cash if the value of the Goods received is lower than the current value of the Gift Card. The remaining, unused value of the Gift Card remains available for use by the User during the validity period of the Gift Card.
  • If the price of the Goods purchased by the User is higher than the amount of funds on the Gift Card, the User is obliged to pay the difference using electronic payment methods available in the Ph.Doctor Online Store.
  • The Electronic Gift Card is not included in the free delivery for orders over PLN 299 in the Ph.Doctor Online Store.
  • The Issuer has the right to refuse to make a payment with an Electronic Gift Card in the event of earlier use of the Electronic Gift Card Code, expiry of the validity period of the Electronic Gift Card. The Issuer has the right to refuse to make a payment with an Electronic Gift Card also in the event of temporary technical problems with the execution of the payment with the Electronic Gift Card and any irregularities in the scope of the Electronic Gift Card Code, until the problem is explained and resolved.
  • The Electronic Gift Card, together with the Electronic Card Code, is a bearer card and may be transferred to another person who becomes its User from the moment of transfer.
  • The Electronic Gift Card after its validity period expires ceases to be active and does not entitle to make further purchases. In the event that, despite the expiry of the validity period of the Electronic Gift Card, unused amounts remain on it, these amounts are not refundable and cannot be the subject of any claims by the User.
  • The User is responsible for the correct use and security of the Electronic Gift Card. The Issuer is not responsible for the use of the Electronic Gift Card by a person who came into possession of it illegally or as a result of the Purchaser providing incorrect data for sending the Electronic Gift Card (e-mail address) or for other reasons not attributable to the Issuer after it has been transferred to the Purchaser or to a person indicated by the Purchaser. In such cases, referred to above, the Electronic Gift Card is not subject to restoration.

  1. Return of goods purchased with an Electronic Gift Card
  • In the event of a complaint decision to accept the return of Goods purchased using an Electronic Gift Card, the User will receive in return the equivalent of the price of the complained Goods at the time of the Electronic Gift Card's redemption; in the form of an Electronic Gift Card with the value of the refund, and in cases where this is not possible, in cash or by bank transfer to the indicated bank account. In the latter case, the condition for the refund of the price of Goods purchased using an Electronic Gift Card is the prior provision of the account number to which this refund is to be made.
  • When returning Goods purchased in the Ph.Doctor online store using an Electronic Gift Card, the User will receive a refund of the price of the Goods at the time of the Electronic Gift Card's redemption, in the form of an Electronic Gift Card with the value of the refund, and in cases where this is not possible, by bank transfer to an account. In this case, the condition for the refund of the price of Goods purchased using an Electronic Gift Card is the prior provision of the account number to which this refund is to be made.

  1. Personal Data Protection
  • The Publisher is the administrator of the personal data of the Purchaser and persons indicated by the Purchaser.
  • Personal data are processed by the Publisher in accordance with legal regulations and solely for purposes related to the Publisher's activities in the scope of: issuing Gift Cards, executing and handling transactions using Gift Cards, communicating with Users and handling complaints, as well as archiving and recording activities.
  • Personal data are processed on the basis of: a) the sales agreement for the Electronic Gift Card, b) protection of the interests of the holder of the Electronic Gift Card (including delivery of the Electronic Gift Card, handling communications, consideration of complaints), or c) the legitimate interest of the Issuer (e.g. defense against claims or, in the case of third party data provided by Users – indication of another person’s delivery address).
  • Providing the Issuer with personal data is voluntary, however, failure to provide certain personal data may result in difficulties or the impossibility of purchasing an Electronic Gift Card via the Ph.Doctor Online Store, its effective delivery and execution.
  • Personal data is stored for the period necessary to perform the activities necessary to purchase Electronic Gift Cards by Users and other activities indicated in the Regulations. After this period, the data may be processed based on: legal obligations of the Issuer (e.g. in the scope of storing accounting documents), or legally justified interest (defense against claims that may be due to the Seller).
  • The Publisher ensures that persons whose personal data is processed have the right to exercise their rights under the law, including the right to access the content of their own personal data, to rectify, change, delete or transfer it, and also the right to request the restriction of the processing of personal data and to object to such processing under the principles specified in the relevant regulations. In addition, in the case of voluntary consent to the processing of data, each person whose data is processed has the right to withdraw consent to the processing of data. Each person whose data is processed also has the right to lodge a complaint with the President of the Office for Personal Data Protection.
  • Personal data relating to Users and other persons whose data has been provided by the User are protected by the Publisher against disclosure to unauthorized persons, as well as other cases of disclosure or loss or unauthorized modification of the indicated data and information by applying appropriate technical and organizational security measures.
  • In matters concerning the processing of personal data not regulated in these Regulations, the relevant provisions of the Privacy Policy shall apply, the content of which is available on the website phdoctorlab.pl in the "Privacy Policy" tab Privacy Policy – ​​Ph.Doctor (phdoctorlab.pl) .

  1. Complaints
  • The User has the right to file a complaint in the event of unjustified charging of the Electronic Gift Card and for other justified reasons related to the purchase or redemption of the Electronic Gift Card.
  • Complaints can be submitted electronically via the contact form available on the phdoctorlab.pl website in the “Contact” tab : Contact – Ph.Doctor (phdoctorlab.pl) .
  • The complaint should include: name and surname, contact details, circumstances justifying the complaint, as well as the User's specific request related to the complaint being filed. It is recommended to attach documents to the complaint that justify it and may be helpful in resolving the complaint.
  • If the data or information provided in the complaint requires supplementation, before considering the complaint, the Publisher will ask the User submitting the complaint to supplement it in the indicated scope.
  • The Publisher will consider the case within 14 days of receiving a properly prepared complaint. The User will receive information on how the complaint will be considered via electronic correspondence, to the address provided by him during registration or in writing. In the event of rejection of the complaint, the Publisher will notify the User of this, providing the reasons for this decision.
  • The Seller does not accept any parcels sent cash on delivery.
  • If the complaint is accepted, the Program Publisher will issue the User a new Electronic Gift Card with a value equivalent to the funds accumulated on the complained Gift Card. The validity period of the Electronic Gift Card will be at least equal to the validity period applicable to the complained Electronic Gift Card.
  • A user who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including:
    • may refer the case to a permanent consumer arbitration court operating at the Trade Inspection with a request to resolve the dispute;
    • may apply to the provincial inspector of the trade inspection with a request to initiate
    • mediation proceedings for the amicable settlement of the dispute;
    • may take advantage of free assistance in matters of out-of-court dispute resolution and claim settlement from district (municipal) consumer ombudsmen and social organizations whose statutory tasks include consumer protection;
    • can use the European ODR (Online Dispute Resolution) platform.

  1. Final provisions
  • The content of the Regulations is available on the website of the Ph.Doctor Online Store phdoctorlab.pl .
  • The Publisher reserves the right to make changes to the Regulations for important reasons, i.e.: changes in legal regulations; the need to adapt the Regulations to the positions of court rulings, changes in payment and delivery methods, organizational changes affecting the Publisher's services, the occurrence of important reasons of a technical and organizational nature, such as the emergence of new technologies and IT systems - to the extent to which these changes affect the implementation of the provisions of these Regulations.
  • In the event of a change to these Regulations, the Publisher will inform the Participants about this on the Ph.Doctor Online Store website. The Regulations shall enter into force on the day indicated in their change, no shorter than 14 days from the date of their announcement by the Publisher, with the proviso that changes of a technical and informational nature or those that do not worsen the situation of the Participants may occur in a shorter period.
  • The change to the Regulations does not violate the rights acquired by the Buyer or the User who is a Consumer before the date of entry into force of the changes to the Regulations, in particular the changes to the Regulations will not affect the Orders placed, the Sales Agreements being executed or performed.
  • In matters related to the Ph.Doctor Online Store, not regulated in these Terms and Conditions for Gift Cards (Ph.Doctor Vouchers), the Terms and Conditions of the Ph.Doctor Online Store shall apply, the current content of which is always available on the Ph.Doctor Online Store website phdoctorlab.pl .
  • In the event of any inconsistency between the provisions of the Regulations and the mandatory provisions of law, the provisions of these Regulations shall apply instead of the provisions of the Regulations, and the remaining part of the Regulations shall remain in force.
