PROMOTION TERMS AND CONDITIONS

"Promotion on the occasion of the 4th birthday of the Ph.Doctor brand "

• § 1. Introductory provisions

1. These Regulations define the rules of participation in the promotion "Promotion on the occasion of the 4th birthday of the Ph.Doctor brand" (hereinafter referred to as the "Promotion").
2. The Organizer of the Promotion is Ph Doctor N&D Wiśniewscy spółka komandytowo-akcyjna with its registered office at: 07-200 Wyszków, ul. F. Chopina 13/U2, entered into the Register of Entrepreneurs maintained by the District Court in Białystok, 12th Division of the National Court Register under the KRS number 0000951237, REGON 388686123, NIP 7622012301.

7. The entity solely responsible for conducting the Promotion is the Organizer.
8. The Promotion will be announced on the website of the Online Store, on the Instagram profile instagram.com/ph.doctor_dermocosmetics and on the Tik Tok platform www.tiktok.com/@ph.doctor_dermocosmetics .
9. The Promotion is conducted on the principles described in these Regulations, in accordance with generally applicable provisions of law.
10. The Promotion is not a game of chance within the meaning of the Act of 19 November 2009 on gambling (i.e. Journal of Laws of 2020, item 2094, of 2021, items 802, 815).

• § 2. Duration of the Promotion

1. The Promotion begins on August 19, 2024 at 10:00 a.m. and ends on August 22, 2024 at 11:59 p.m. (hereinafter: "Promotion Time Frame").
2. Responses to the promotion task referred to in § 4 of the Regulations must be sent within 7 days of receiving the order.

• § 3. Conditions of participation in the Promotion

1. Participation in the Promotion and the related provision of data is completely voluntary. A person who has entered the Promotion and met the conditions contained in the Regulations (hereinafter "Participant") is bound by the terms of these Regulations.
2. It is the responsibility of each Participant to read the Regulations and the Information Clause from § 9 of the Regulations before participating in the Promotion and to comply with their rules. If the Organizer finds a violation of the provisions of the Regulations, the Organizer has the right to exclude from the Promotion the Participant who has violated the Regulations.
3. Taking part in the Promotion is equivalent to:
1. reading and accepting the provisions of the Regulations containing consent to use the Participant’s image and data under the terms specified in the Regulations, including § 9 and to grant licenses and consents in accordance with § 8,
2. a commitment to comply with the Regulations as well as a declaration of fulfillment of the conditions for participation in the Promotion and performance of the promotion tasks in accordance with the Regulations.
4. The Promotion is open to persons who meet all the conditions in points 1 and 2 below:
   1. natural persons who are over eighteen years of age and have full legal capacity,
   2. people who:

• in the period from 19/08/2024 to 22/08/2024, they will purchase any product or products (Organizer’s Products) in the Online Store for any amount on the website www.phdoctorlab.pl;
• correctly complete the promotion task described in § 4 of the Regulations.

5. The 4th birthday promotion does not include the purchase of Ph.Doctor gift vouchers (for which separate regulations apply, published on the website www.phdoctorlab.pl).
6. Creating accounts or submitting promotion entries on behalf of third parties is prohibited.
7. Employees of the Organizer and their spouses, ascendants, descendants, siblings, adoptees and adoptive parents are not eligible to participate in the Promotion.
8. The condition for effective participation in the Promotion and applying for the Prize is: familiarisation with the provisions of the Regulations and the Information Clause regarding the processing of personal data before starting to carry out the Promotion Task.
9. Participation in the Promotion and the related provision of personal data is completely voluntary and free of charge.
10. By entering the Promotion, the Participant voluntarily consents to the processing of personal data by the Administrator, i.e.
11. name and surname, place of residence, e-mail address from which the purchase was made, telephone number, other personal data provided when placing the order;
12. data confirming fulfilment of the conditions for participation in the Promotion and data necessary to award the Prize in order to enable participation in the Promotion, its organisation, conduct and settlement in accordance with the Regulations.

• § 4. Course of the Promotion

1. The purpose of the Promotion is for the Participant to cumulatively meet the conditions in points 1 and 2 below:
1. making a purchase of the Organiser's Products on the website www.phdoctorlab.pl for any amount between 19/08/2024 and 22/08/2024 and not returning them or not withdrawing from the transaction referred to in connection with registering for participation in the Promotion.
2. after receiving his order with a card informing about the win, the participant:

• will send the order number and promotional code from the card to kontakt@phdoctorlab.pl within 7 days of receiving the shipment,
• will take a photo with a visible promotional code, which will be sent to the address provided within 7 days of receiving the parcel.

3. The 4th birthday promotion does not include the purchase of Ph.Doctor gift vouchers (for which separate regulations apply, published on the website www.phdoctorlab.pl).
4. The Promotion Task must not infringe the rights of third parties.
5. By placing an order, the Participant declares that he or she consents to the processing of personal data.
6. Refund of up to 99.9% of the amount spent on the order within the specified period described in § 2 of the Regulations will be made using the same payment method used in the order and to the same personal data provided when making the purchase.

• § 5. Organizer's Rights

1. After verifying the order number and discount code, the organizer has 30 days to refund the specified amount.
2. The Organizer reserves the right to exclude from participation in the Promotion Participants who do not meet the conditions of participation in the Promotion, their actions are contrary to the law, good customs or the Regulations, in particular Participants who:
1. they do not act personally, but through third parties;
2. use different aliases (additional Profiles, including fictitious accounts) to act on behalf of / report different Participants;
3. are not adults.

3. In order to clarify any doubts related to the Participant’s activity in the Promotion, the Organiser may contact the Participant using the means of communication provided by him/her (e.g. e-mail correspondence).

• § 6. Prizes

1. The promotion provides a discount of up to 99.9% of the amount spent on the order for 400 customers making purchases during the Birthday Promotion.
2. Winners are informed of the Prize once they find a birthday card with a promotional code in their order, which will be added randomly to orders placed between August 19, 2024, 10:00 a.m. and August 22, 2024, 11:59 p.m.
3. Winners are required to send, within 7 days of receiving the shipment, after finding a birthday card with a promotional code in their order, in accordance with §6 sec. 2 of the Regulations, the information necessary to issue the Prize in accordance with §4 sec. 1, via private message to the Promotion email address.
4. The 4th birthday promotion cannot be combined with the purchase of Ph.Doctor gift vouchers (for which separate regulations apply, published on the website www.phdoctorlab.pl).
5. The Organizer has the right to verify the personal data of the Winners at the time of granting a refund of a specific amount in order to determine their age and identify the Winner.
6. The Winner loses the right to the Prize if:
   1. is not of legal age or has not met other conditions for participation in the Promotion;
   2. has not fulfilled all or part of the Promotion Task described in the provision of § 4 section 1 of the Regulations;
   3. has not complied with the deadline specified in §6 section 3 of the Regulations or has not provided the correct communication address or data referred to in §6 section 5 of the Regulations.

• § 7. Complaints

1. Each Participant has the right to submit a complaint during the Promotion Period and after its end.
2. Complaints should be submitted by letter to the Organizer's address or by e-mail to the following address: kontakt@phdoctorlab.pl . The complaint should include the name, surname, address of the person submitting the complaint and a description of the reasons for the complaint, as well as the expected manner of its consideration.
3. Complaints will be considered by the Organizer within 30 (in words: thirty) business days from the date of their receipt. The Participant will be informed of the Organizer's decision by e-mail or registered letter sent to the address provided in the complaint.
4. Complaints will be considered by a complaints committee appointed by the Organizer.

• § 8. Personal data

1. The administrator of personal data collected from Participants and Winners is the Organizer Ph Doctor N&D Wiśniewscy spółka komandytowo-akcyjna with its registered office at: 07-200 Wyszków ul. F. Chopina 13 lok.u2.
2. In matters concerning personal data, the Participant may contact the e-mail address: kontakt@phdoctorlab.pl .
3. Personal data of Participants and Winner:

4. The recipients of the personal data of Participants and Winners will be:
   1. authorized employees of the Organizer;
   2. Service providers who have been entrusted with the processing of Personal Data under an agreement for the purposes of implementing services provided by the Organizer or for the Organizer. These are in particular entities (and their authorized employees) providing IT and technical services, research, analysis and statistics services, entities organizing marketing campaigns. These entities act on behalf of the Organizer to the extent necessary for the proper performance of the services entrusted to them;
   3. Entities authorized to receive Personal Data under legal provisions;
   4. Service providers supplying the Organiser with technical, organisational and management solutions for the Organiser’s business (in particular accountants, banks, courier and postal companies participating in the issuance of Prizes);
   5. Providers of legal and advisory services and those supporting the Organizer in pursuing due claims and defending its rights (in particular law firms and tax offices).
5. The personal data of the Promotion Participant and the Winner will be stored:
   1. for the duration of the Promotion, and after this period for the limitation period for any claims – as a rule, no longer than 6 years;
   2. in the case of data processing for the purposes necessary for the purposes of legitimate interests – until the Promotion Participant objects to the processing of personal data in this respect, but in principle no longer than 6 years;
   3. in the case of data processing for the purposes necessary to fulfil legal obligations in the field of tax and accounting law, for the period specified in the law, generally no longer than 6 years;
   4. until consent is withdrawn.
6. The personal data of the Promotion Participants and the Winner will not be subject to profiling. The Promotion Organizer will not transfer the personal data of the Promotion Participant to third countries.
7. The Participant/Winner has the following rights:
   1. to request access to your personal data, to obtain a copy of your data, as well as to request their rectification, restriction of their processing or their deletion under the conditions resulting from the GDPR;
   2. to the extent that the basis for the processing of personal data is a legitimate interest – to object to the processing of personal data;
   3. to the extent that the basis for the processing of personal data is the performance of a contract or consent – ​​the transfer of personal data, i.e. the right to receive personal data in a structured, commonly used, machine-readable format and to transmit it to another controller, if technically possible.
8. If the Participant considers that the processing of your data violates the provisions of generally applicable law, including the GDPR, you also have the right to lodge a complaint with the competent supervisory authority, which is the President of the Personal Data Protection Office with its registered office at ul. Stawki 2, 00-193 Warsaw.
9. Providing personal data is voluntary and results from the rules of the Promotion. Failure to provide data results in the inability to participate in the Promotion or win the Prize. Consent to the processing of personal data is voluntary, but necessary to participate in the Promotion and receive information about the Prize won in the Promotion; the Participant's data will be processed only in connection with the participation of this Participant in the Promotion, communication based on the data provided will take place only in connection with the Participant's participation in the Promotion and to the extent indicated in the Regulations.
10. The Organizer makes every effort to protect the privacy and information relating to Participants and Winners and, with due diligence, selects and applies appropriate technical measures, including organisational and programming measures, which ensure the protection of processed data [in particular, protects data against disclosure, destruction, loss and making available to unauthorised persons, as well as against unauthorised modification and processing in violation of applicable law].

• § 9. Final provisions

1. The Regulations are available for the duration of the Promotion on the website phdoctorlab.pl, on the Organizer’s profile.
2. Any information about the Promotion contained in any promotional and advertising materials is for informational purposes only. The provisions of the Regulations are binding.
3. All information about the Promotion can be obtained by contacting the Organizer via "private messages" through the Instagram profile available at: https://www.instagram.com/ph.doctor_dermocosmetics/?hl=pl , or by e-mail at: kontakt@phdoctorlab.pl .
